Terms of Service
These Terms of Service (“Terms”) govern your access to and use of inflighttraffic.com and purchases from Off Road Industries LLC, doing business as Inflight Traffic (“Inflight Traffic,” “we,” “us,” or “our”). By using the website or placing an order, you agree to these Terms and our Privacy, Shipping, and Refund policies.
Eligibility and acceptable use
You must be legally capable of entering into a binding agreement to make a purchase. You may not use the website or products for an unlawful, fraudulent, abusive, or unauthorized purpose; interfere with the website’s security or operation; introduce malicious code; scrape or exploit the service improperly; or violate another person’s rights.
Product information and development statements
We attempt to describe products accurately. Images, colors, specifications, dimensions, package contents, compatibility information, software features, availability, and release timing may change before a product’s final commercial release. A statement describing a planned, intended, prototype, beta, or in-development feature is not a promise that the feature will be included in a final product.
Only specifications and package contents shown on the product page at the time a completed order is placed apply to that order. We may correct errors, update information, or cancel and refund an order affected by a material pricing, inventory, or description error.
Orders, pricing, and payment
Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including inventory errors, suspected fraud, payment problems, shipping restrictions, or incorrect product or pricing information. If we cancel a paid order, we will refund the cancelled amount to the original payment method.
Prices are shown in U.S. dollars unless stated otherwise. Applicable shipping charges, taxes, discounts, and the final order total will be disclosed during checkout before payment is submitted. You agree to provide current and accurate billing, shipping, and contact information.
Shipping, returns, and warranty
Shipping is governed by our Shipping Policy. Returns, refunds, replacements, and the IFT-01 one-year limited warranty are governed by our Refund and Return Policy. Those policies are incorporated into these Terms.
Aviation-use notice
IFT-01 is a portable ADS-B In receiver intended only to provide supplemental situational-awareness information. Unless expressly stated otherwise in final product documentation:
• It is not FAA-certified avionics;
• It is not ADS-B Out equipment and does not satisfy ADS-B Out requirements;
• It is not a collision-avoidance system;
• It is not approved as a primary navigation, traffic, or weather source; and
• It does not replace required installed equipment, official weather sources, air traffic control instructions, visual scanning, sound aeronautical decision-making, or pilot judgment.
Traffic, weather, position, and other displayed information may be incomplete, delayed, inaccurate, unavailable, or affected by aircraft equipment, ground coverage, rebroadcast availability, signal reception, installation or placement, interference, software compatibility, connected devices, external data sources, or other conditions.
The pilot in command remains solely responsible for the safe and lawful operation of the aircraft. Never rely on IFT-01 as the only source of information for any safety-critical decision.
Compatibility and third-party services
References to third-party applications, devices, aircraft, services, or trademarks are for compatibility or identification purposes and do not imply sponsorship, endorsement, certification, or affiliation. Third-party software, services, broadcasts, and devices are controlled by their respective providers and may change or become unavailable.
Compatibility is limited to the combinations, versions, and functions expressly identified as supported in current Inflight Traffic documentation. We are not responsible for third-party changes or outages.
Intellectual property
The website and its original text, graphics, logos, product names, designs, photographs, software, and other content are owned by or licensed to Off Road Industries LLC and are protected by applicable intellectual-property laws. You may use the website only for personal or legitimate business purchasing purposes. No license is granted except as necessary to use the website and purchased products as intended.
User submissions and feedback
You remain responsible for content you submit. You may not submit unlawful, infringing, deceptive, malicious, or abusive material. If you voluntarily provide product ideas or feedback, you grant us permission to use that feedback without restriction or compensation, but we will handle personal information according to our Privacy Policy.
Disclaimers
To the fullest extent permitted by law, the website and website content are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free website operation. Product warranties are limited to the express written warranty stated in our Refund and Return Policy. We do not disclaim warranties or consumer rights that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Off Road Industries LLC and its owners, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, loss of use, or business interruption, arising from the website or products.
To the fullest extent permitted by law, our aggregate liability arising from a purchased product will not exceed the amount paid for that product. These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Off Road Industries LLC harmless from third-party claims, losses, or expenses arising from your unlawful use, unauthorized modification, misuse of a product, or violation of these Terms. This provision does not apply to the extent a claim results from our own unlawful conduct or where prohibited by law.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute that is not subject to a mandatory consumer-protection venue will be brought in a court of competent jurisdiction located in Washington County, Utah. Nothing in these Terms limits rights provided by applicable consumer-protection law.
Changes to these Terms
We may update these Terms from time to time. The version in effect when an order is placed will govern that order. Continued use of the website after an update constitutes acceptance of the revised Terms for future use.
Severability and entire agreement
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with the policies incorporated by reference and any product-specific terms shown at purchase, form the entire agreement concerning use of the website and the applicable purchase.
